telephone association to recover damages from six other
stockholders for the alleged breach of a first-option stock
purchase agreement. The trial court sustained a motion for
summary judgment filed by the appellees which was based upon
certain admissions and answers to interrogatories made by
appellant and the sworn testimony of the appellant in a
collateral action involving the same subject matter. The issue
presented to this court is whether or not the trial court erred
in granting summary judgment to the appellees. The factual situation which brought about this litigation is
not greatly in dispute and is essentially as follows: The
